These terms govern the website ownyourmailserver.com and the services provided under the Own Your Mail Server name ("we", "us"). By using the site or engaging our services you agree to them.
1. The service
We provide a done-for-you build of email-sending infrastructure (including a dedicated server, dedicated sending IP addresses, domain and mailbox administration software, and DNS authentication records) provisioned in hosting, domain and DNS accounts opened and held in your own name ("the Build"). The exact scope, specification, delivery timeline and one-time price of each Build are agreed in writing before work begins.
The Build does not include email-sending, sequencing or warm-up software. Warm-up and ramp guidance is provided as documentation through the Playbook; carrying it out remains your responsibility, using whatever sending tools you choose.
2. Payment
The Build is charged as a one-time fee, as agreed in your written specification. Following handover, ongoing third-party costs (including server hosting and domain registrations) are payable by you directly to the relevant providers and are not our responsibility. Those costs are what keep the infrastructure running.
3. Ownership and handover
The Build is provisioned in accounts held in your name, so you are the owner and controller of the infrastructure throughout. There is no transfer of ownership from us to you, because it is never ours. At the handover call we deliver the credentials and documentation and walk you through operating it. You are responsible for its operation, security, maintenance and all associated third-party costs.
4. The Playbook
Clients receive access to the Playbook, our documentation and research library, for as long as we publish it. It is licensed to you for your own use, may be updated or revised at any time, and may not be redistributed or resold.
5. The Full Keys Guarantee
Where we agree a specification in writing, we will continue working at no additional charge until the Build meets that specification. This guarantee applies to the delivery of the Build and does not extend to the results you obtain from using it, including email deliverability outcomes over time, which depend on factors within your control such as sending behaviour, list quality and volume.
6. Acceptable use
You agree to use the infrastructure lawfully, including compliance with applicable email and privacy legislation (such as the UK GDPR, PECR, the EU GDPR and the US CAN-SPAM Act) and the acceptable-use policies of your hosting and domain providers. We may decline or discontinue work that we reasonably believe will be used for unlawful spam, phishing or fraud; where that determination is made before handover it will be accompanied by a refund of fees paid for undelivered work.
7. Liability
Nothing in these terms limits liability that cannot be limited by law. Subject to that, we are not liable for indirect or consequential losses, loss of profit, or losses arising from your use or operation of the infrastructure after handover, and our total liability in connection with a Build is limited to the fees you paid for it.
8. Intellectual property
The software installed as part of the Build is open-source software licensed to you under its respective licences. Website content and branding remain ours. Third-party names and logos shown on this site are the property of their respective owners and are used only to identify compatibility.
9. General
These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction. If any provision is found unenforceable, the remainder stays in effect. We may update these terms; the version on this page at the time of your engagement applies.
